The recognition of the accredited professional organization shall be based upon a Board Resolution subject to the approval by the Commission, directing the issuance of a Certificate of Accreditation pursuant to the above-stated rule and PRC Res. No. 179, Series of 2004 upon payment of the prescribed therefore.

Therefore, Resolution No. 03, Series of 2008 was validly promulgated after findings of the Commission and Board that CCBI complied with the requirements of the law for renewal of its accreditation and being chosen as Accredited Professional Organization for all the professionals of Customs Brokers. In effect, PCBAPI was not selected by the Board and the Commission.

With respect to the other prayers of PCBAPI against respondents, the Commission sees no reason to grant the

same for lack of basis.

The charges of immorality against the Chairman of the Board of Customs Brokers and selling of books to examinees by Board Member Ferdinand Nague are likewise dismissed for being mere allegations and for lack of evidence.

WHEREFORE, premises considered, Board Resolution No. 3, Series of 2008 is valid and consequently, the Records Division of this Commission is directed to publish the said Resolution. The prayers and other charges of PCBAPI against respondents are denied and dismissed, respectively, based on the above stated reasons.

"Section 31. Integration of Marine Deck/Engineer Officers. All marine deck/engineer officers shall be integrated into one (1) national organization which shall recognized by the Board and by the Commission as the one and only integrated and accredited association of Marine Deck/Engineer Officers. A Marine Deck/Engineer Officer duly registered with the Board shall automatically become a member of the integrated and accredited association of Marine Deck/Engineer Officers, and shall receive the benefits and privileges appurtenant thereto upon payment of the required fees and dues, Membership in the integrated and accredited association shall not be a bar to membership in other associations of marine deck/engineer officers." WHEREAS, in support of its application are the following, to wit:

1. Notarized petition signed by its President for the renewal of the certificate of accreditation;

2. List of current officers including its chapters;

3. Photo copy of Certificate of Registration issued by the Securities and Exchange Commission (SEC);

4. Photo copy of the Amended Articles of Incorporation and By-Laws;

5. Copy of audited financial statement submitted to the SEC duly signed by a Certified Public Accountant;

6. Complete list of members indicating their PRC Registration Nos. and Dates of Registration;

7. Report on significant achievements as a corporate body; and

8. Proof of payment of the prescribed renewal fee.

WHEREAS, Commission Resolution No. 2004-178, Series of 2004, dated January 29, 2004, provides the Rules Governing the Status of the present Accredited Professional Organizations (APOs), Accreditation of New/Future Professional Organizations, the Renewal of the Certificates of Accreditation, and their Cancellation/Suspension, among others, to

wit:

"RULE 3. Renewal of Certificate of Accreditation.

The accredited professional organization shall renew its Certificate of Accreditation once every three (3) years after the date of the herein

Resolution granting the petition for accreditation and the issuance of the said certificate upon submission of the requirements enumerated hereunder and payment of the prescribed fees provided that the certificate of accreditation has not been cancelled or revoked under any of the causes/grounds set forth in Rule 4 hereof."

WHEREAS, after a careful perusal of the documents submitted, applicant substantially complied with the requirements for the renewal of accreditation.

NOW, THEREFORE, the Board RESOLVED, as it hereby RESOLVES to approve and issue the renewal of Certificate of Accreditation to the Masters and Mates Association of the Philippines, Inc. (MMAP) as the one and only accredited national organization for Marine Deck Officers.

Accordingly, it is hereby reiterated to the applicant Rule 4, Resolution No. 2004-178, Series of 2004, dated January 29, 2004, which read as follows:

"Cancellation of Accreditation. - A certificate of accreditation of an accredited professional organization shall be cancelled or suspended by the Commission or by the concerned professional regulatory board upon approval or concurrence by the Commission only after due hearing under any of the following grounds/causes:

1. The accredited professional organization has ceased to possess any of the qualifications for accreditation.

2. The accredited professional organization no longer served the best interest of the profession for which it was accredited.

3. The membership of the accredited professional organization falls 50% or below of those who

have been issued their annual registration cards for the current year.

4. The accredited professional organization has committed acts inimical to its members and to the profession.

5. The accredited professional organization has not renewed its certificate of accreditation after a lapse of an unreasonable period from the date of its renewability.

6. The accredited professional organization and/ or its chapter organizations has not submitted audited financial statements thereof."

FURTHERMORE, RESOLVED, this Resolution shall take effect after fifteen (15) days following the full and complete publication thereof in the Official Gazette or any newspaper of general circulation in the Philippines.

Let a copy of this Resolution be furnished the applicant for its information and guidance.

alleging among others: that he is of legal age, married, an Iranian Citizen, and a resident of No. 100 Camia Road, Ayala Alabang, Muntinlupa City; that he was born on May 23, 1959; that he arrived in the Philippines sometime on October 31, 1980; that he is married to RUBY ANN V. 5. Petitioner has four (4) children with Ruby Ann, namely: i) Mehdi Hassan

Petitioner, by counsel, respectfully states: Haghighi Fard ii) Farah Christine Hassan

1. Petitioner Mohammad Hassan Hassan Haghighi Fard a.k.a. Hasan Fard is of legal age, married, Iranian Citizen, and a resident of No. 100 Camia Road, Ayala, Alabang, Muntinlupa. He was born in Tehran, Iran, on May 23, 1959. His father is Ahmad Hassan Haghighi Fard and his mother is Kobra Beigum Hosseini Hassan Haghighi

A copy of his translated Birth Certificate is attached as Annex "A" and two (2) copies of his latest photographs as Annexes "B" and "B-1".

2. Petitioner arrived in the Philippines sometime on October 31, 1980 on board the Thai International Airline plane and initially resided at 45 Maginoo St. V. Luna, Quezon City. Since then, he has continuously resided in the Philippines for a period of twenty eight (28) years before the filing of this Petition. He was issued his Alien Certificate of Registration (ACR) No. 321427 and Immigrant Certificate Residence (ICR) No. 222424, both on November 28, 1980.

Copies of the Certificate of Arrival issued by the BID, Alien Certificate of Registration (ACR) and the Immigration Certificate of Residence (ICR) are attached as Annexes "C", "D" and "E", respectively.

3. Petitioner studied in the Philippines at the University of Santo Tomas (UST) and finished the degree of Bachelor of Science in Electronics and Communication Engineering in 1985.

4. Petitioner is married to Ruby Ann V. Fard, a Filipina, on July 18, 1985 and they are happily married for the past twenty two (22) years. As a married couple, they initially stayed at No. 1 Arsenio Jizon, BF Homes, Parañaque City and transferred to their present abode at No. 100 Camia Road, Ayala, Alabang Muntinlupa.

Copies of the Birth Certificates of petitioner's children are attached as Annexes "G", "H", "I" and "J".

6. Petitioner's children are Filipinos, were all born in the Philippines and they were brought up embracing the culture, traditions and customs of a Filipino. His children had studied either at Ann Arbor Montessori, BF Homes Parañaque, International Christian Academy (ICA) at Fourth Estate Subdivision, Parañaque, and at the British School Manila (BSM). All of these schools are duly recognized by the Department of Education, Culture and Sports. All of petitioner's children were taught Philippine history, government and civics as part of their school curriculum.

7. Petitioner has not been charged or accused, much less convicted, of any offense nor has he been involved in any felony. He has conducted himself in a proper and irreproachable manner during the entire period of his stay in the Philippines in relation with the duly community in which he relates. He believes constituted government as well as in the in the principles underlying the Philippine Constitution.

8. Petitioner is not suffering from any mental alienation or incurable disease. He has mingled socially with Filipinos and had learned to embrace the customs, traditions and ideals of the Filipinos.

9. He is gainfully employed and is presently holding the position of Assistant Vice President of Adcoms International and Chairman and Chief Executive Officer (CEO) of Trends and Technologies Inc.

10. Petitioner has been dutifully reporting his income and paying income taxes.

11. Petitioner posses all the qualifications for naturalization as a Filipino citizen as
