HSIEH, TSUNG HSIEN, Petitioner

AMENDED ORDER

This is a petition for naturalization filed by Hsieh, Tsung Hsien through counsel on May 18, 2009.

The petition alleges, among others, that petitioner Hsieh, Tsung Hsien was born on January 26, 1965 in Changhua Hsien, Taiwan and immigrated to the Philippines on January 13, 2007. He has, since then resided at B-12 High Street, Grace Village, Quezon City. He is a businessman engaged in animal feed productions since 1993 up to the present from which he derives an annual gross of Php187,200.00 and other benefits. Pursuant to Commonwealth Act No. 473, he went to the Office of the Solicitor General and filed a Declaration of Intention to become a citizen of the Philippines. He is married to Wu, Chu Chen on July 28, 1965 and able to speak and

write English, Chinese and Tagalog. He is a person of good moral character; believes in the principles underlying the Philippine Constitution, conducted himself in a proper and irreproachable manner during the period of his residence in the Philippines in his relation with the constituted government as well as with the community in which he resides. He has mingled socially with Filipinos and has evinced a sincere desire to learn and embrace the customs, traditions and ideals of the Filipino people. He has all the qualification required under Section 2 and none of the disqualifications provided under Section 5 of Commonwealth Act No. 473, as amended.

He is not opposed to organized government or affiliated with any association or group of persons who uphold and teach doctrines opposing all organized governments. He is not defending or teaching the necessity or propriety of violence, personal assault or assassination for the success or predominance of men's idea. He is not a polygamist or a believer in the practice of polygamy. He has not been convicted of any crime involving moral turpitude. He is not suffering from any incurable contagious disease or from mental alienation. The nation of which he is a citizen is not at war with the Philippines.

He will reside continuously in the Philippines from the time of the filing of this petition up to the time of her admission as citizen of the Philippines. He intends to present Peter Ong Co and Romeo Ong, residents of Quezon City and Pangasinan, respectively as his witnesses.

Finding the verified petition to be sufficient in form and substance, let this petition be set for hearing on February 11, 2010 at 8:30 o'clock in the morning, before this Court sitting at the Annex of the Hall of justice Building, Quezon City Hall Compound, Quezon City.

Any interested person may appear and show cause, if there be any why the petition should not be granted.

Let a copy of this petition be published once a week for three consecutive weeks in the Official Gazette and in a newspaper of general circulation in Quezon City to be chosen by raffle at the expense of the petitioner.

Let copies of the petition and this Order be posted at the bulletin board of this Court, at the lobby of the Hall of Justice and in the Barangay Hall of the Barangay where the petitioner resides.

Likewise, let copies of the petition and this Order be furnished the Office of the Solicitor General.

SO ORDERED.

Fifth: I am married to Wu, Chu, Chen, 43 years old, having been born on 28 July 1965 in Changhua Hsien, Taiwan and with whom I have triplet children namely: 1) HSIEH, BING HENG: 2) HSIEH, BING RONG and 3) HSIEH, BING ZHEN all born on 7 November 2000 in Taichung City, Taiwan. My wife and three children are presently residing with me at 16 B Church Street, Grace Village, Quezon City, Metro Manila, Philippines.

Ninth: I have resided continuously for the last eighteen (18) years in the Philippines since my arrival;

Eleventh: I believe in the principles underlying the Philippine Constitution; I am of good moral character and have conducted myself in a proper and irreproachable manner during the entire period of residence in the Philippines, in my relations with the constituted government as well as with the community in which I am living; I have mingled socially with the Filipinos, and has evinced a sincere desire to learn and embrace the customs, tradition, and ideas at the Filipinos. I am not suffering from mental alienation or incurable disease; The nation of which I am a citizen of subject is not at war with the Philippines. The country of which I am a citizen or subject grants Filipinos the right to become naturalized citizens or subject thereof;

Thirteenth: It is my intention in good faith to become a citizen or subject of the Philippines and to renounce absolutely and forever all allegiance and fidelity to my foreign prince, potentate, state, or sovereignty, and particularly to the Republic of China of which at this time I am a citizen

or subject. I will reside continuously in the Philippines from date of the filing of my petition up to the time of my admission to the Philippine Citizenship;

Fourteenth: I have not heretofore made petition for citizenship to any Court;

Fifteenth: That Mr. Peter Ong Co of legal age, residing at No. 25 Panaturan corner Banaue Streets, Barangay Manresa, Quezon City and Romeo Ong So of legal age, residing at Carmen Rosales, Pangasinan; who are Filipino citizens, will appear and testify as witnesses at the hearing of this petition;

Sixteenth: Attached hereto and made integral part at this petition are:

Annex "A" - Petitioners' Declaration of Intention dated July 13, 2007 and filed with the Office of the Solicitor General on September 11, 2007.

Annex "B" - Petitioners' Certificate of Arrival signed and issued by the Commissioner of Immigration of the Philippines.

Annex "C" and "D" Affidavit of witnesses

Annex "E" and "E-1" - my two (2) recent photographs duly signed.
