ORDER

Before this Court is a verified petition filed by Nelson P. Batingal with postal address at Brgy. Iba, Silang, Cavite, Philippines, praying before this Court that after due notice and hearing, an order be issued directing the Register of Deeds for the City of Tagaytay to reconstitute the original of TCT No. T-78445 (Book 387; Page 45) deemed lost in its file, in the name of the registered owner, Nelson P. Batingal, and in exactly the same terms and conditions as appearing in the owner's duplicate certificate of said transfer certificate of title duly issued and presently in the custody of petitioner, upon payment of all fees required by law. The description of the said property is as follows:

"A parcel of land (Lot No. 2, plan Psu-57442), with the improvements thereon situated in the Bo. of Iba, Mun. of Silang. Bounded on the N. by property of Faustino Madlangsakay, on the SE., by a creek, on the S., by property of Jose Madlangsakay and on the NW. by property of Benedicto Velasco. Beginning at a pt. marked "1" on plan being S. 86 deg. 23'E., 985.60 m. from MDLM No. 1, Silang, thence S. 80 deg. 18'E., 52.73 m. to pt. 2; thence S. 80 deg. 17'S., 30.00 m. to pt. 3; thence S. 34 deg. 38'W., 61.63 m. to pt. 4; thence N. 87 deg. 31'W., 15.01 m. to pt. 5; thence N. 87 deg. 33 W., 45.02 m. to pt. 6; thence N. 12 deg. 13.6., 63.52 m. to pt. of beginning, containing an area of

Wherefore, finding the petition to be sufficient in form and in substance, the same is hereby given due course.

Notice is hereby given that the said petition shall be heard on November 27, 2013 at 8:30 o'clock in the morning, where all interested parties are cited to appear why the petition should not be granted.

ORDER

Petitioner filed a verified petition on May 31, 2013, praying therein that after due notice and hearing an order be issued that owner's duplicate copy of Transfer Certificate of Title No. T-123416 be declared lost or destroyed in the files of the Registry of Deeds of Guiguinto, Bulacan; that the original copy of Transfer Certificate of Title No. T-123416 be declared destroyed and be reconstituted by the Registry of Deeds of Guiguinto, Bulacan on the bases of the technical description, approved plan and other documents in accordance with law; and to issue a new owner's duplicate copy of Transfer Certificate of Title No. T-123416 in accordance with law, with the same faith, like and credit as the original.

The petition alleges that petitioner is of legal age, married to Mariano M. Palazo, Filipino citizen, and resident of No. 4 Oak Street, West Fairview, Barangay Fairview, Quezon City where they may be served with court processes and documents; that the petitioner is the administrator and one of the heirs of the registered owners of Damaso and Josefa Dayao, as per Letters

Administration issued by the Regional Trial Court of Manila, Branch 6 on October 18, 2010 in Sp. Proc. No. OT-117461; that one of the legal properties left by the Sps. Damaso and Josefa Dayao is a parcel of land covered by Transfer Certificate of Title No. T-123416 particularly described as follows:

A parcel of land (lot 164-A of the subdivision plan (LRC) PSD-115477, being a portion of Lot 164, Malolos (Cadastre L.R.R. CAD. Record No. 501), situated in the Barrio of Sto. Rosario, Municipality of Malolos, Province of Bulacan, Island of Luzon. Bounded on the NE., points 2 to 3 by Lot 163, Malolos Cadastre; on the SE., and SW., points 3 to 4 to 1 by Lot 164-B of the subdivision plan; on the NW., points 1 to 2 by Calle Zulueta. Beginning at a point marked “1” on plan, being S. 8 deg. 03'W., 97.33 m. from BBM 39, Malolos Cadastre. Thence N. 64 deg. 15'e., 8.20m. to point 2; thence S. 26 deg. 08'e., 19.80m. to point 3; thence S. 63 deg. 32'W 10.23m. to point 4; thence N. 30 deg. 29'W., 2.76m. to point 5; thence N. 18 deg. 42'W., 17.31m. to the point of; Beginning, containing an area of One Hundred Eighty Eight (!* *) Square Meters, more or less. that the property described were listed among those properties as part of the estate of the deceased spouses Damaso T. Dayao and Josefa C. Dayao in Petitioner's Petition in the Regional Trial Court of Manila; that the owner's duplicate copy of Transfer Certificate of Title No. T-123416 was destroyed and lost when their ancestral home was damaged by the flood due to tropical depression "Ondoy"; that petitioner being the court administrator executed an affidavit of loss and have the same be

registered with the Office of the Register of Deeds concerned; that Transfer Certificate of Title No. T-123416 located in Malolos, Bulacan the Affidavit of Loss was entered in the Registry of Deeds (Guiguinto Branch) on April 3, 2013 as per Entry No. 2013003868; that the original on file with the registry was among those burned in the conflagration that gutted the said office on March 7, 1987; that the real estate tax for the current year has been fully paid; that the said property was part of a bigger property which was subdivided in favor of Damaso Dayao and Gregoria Dayao; that Damaso Dayao during his lifetime was the one who caused the subdivision which resulted to the issuance of TCT No. T123416 registered under his his name sometime in 1970; that its existence prior to its lost during the height of Typhoon Ondoy in September 29, 2009 can be proven by the aforementioned documents; that there are no pending transactions involving the said properties before the Registry of Deeds (Guiguinto Branch); that petitioner have not delivered the same to any person to secure any obligation, transaction or lien; that the adjoining owners of the subject property are as follows:

that all of them were furnished each with the copy of the petition; that the subject property was not reserved by government for any of its instrumentalities for any of its purposes and neither subject property covered by the Agrarian Reform Program of the State; and that the petitioner being the administrator and her co-heirs are in possession of the subject property.

The Court hereby sets the petition for hearing on December 12, 2013 at 8:30 o'clock in the morning before this branch of the Court, on which date, time and place, all interested persons are hereby required to appear and show cause, if any they have, why the petition should not be granted.

Let copies of this Order be published in two (2) successive issues of the Official Gazette at the expense of the petitioner with the last issue not less than thirty (30) days prior to the date of hearing above-fixed. Also, let copies of this Order be posted by the Deputy Sheriff of this Court, at the Bulletin Board of this Court, at the main entrance of the Provincial Capitol Building of Bulacan, Malolos, Bulacan, and in conspicuous place where the property is located.

Further, let copies of this order be furnished the Office of the Solicitor General, the Office of the Land Registration Authority, the Office of the Register of Deeds of Bulacan, (Guiguinto Branch), the Office of the Provincial Prosecutor of Bulacan, as well as the adjoining owners of the property subject of this petition.

Likewise, petitioner is hereby directed to furnish the above agencies with copy of the petition together with its annexes within five days from receipt hereof and to submit compliance in court within a like period. SO ORDERED.
