ORDER

The petition being sufficient if form and substance, let the same be set for hearing on January 23, 2014 at which date, hour and place, any person interested may appear and show cause why the petition should not be granted. At his expense, petitioner is directed to have this Order published in two (2) successive issues of the Official Gazette and cause the posting thereof in the bulletin board of the Provincial Capitol Building, Trece Martires City, Municipal Building of Naic, Cavite, and in the bulletin board of this Court for at least thirty (30) days prior to the date of hearing pursuant to the provisions of Republic Act No. 26.

Petitioner is likewise directed to comply with the provisions of LRA Circular No. 35 dated June 13, 1983, wherein it is mandated that the signed duplicate copy of the petition to be forwarded to the LRA shall be accompanied by a duly prepared plan of said parcel of land in tracing cloth, with two (2) blue print copies thereof prepared by the government agency which issued the Certified Technical Description, or by a duly licensed Geodetic Engineer who shall certify thereon that he prepared the same on the basis of a duly certified technical description. It shall also be accompanied by the original of the technical description of the said parcel of land covered by the Certificate of Title, duly certified by the authorized officer of the Bureau of Land or LRA who issued the technical description, and a signed copy of the Certification of the Register of Deeds concerned that the original of the certificate of title on file to the Registry was either lost or destroyed.

Let copy of this Order be furnished the Land Registration Authority, Quezon City, Register of Deeds of Cavite Province and the Solicitor General, Makati City, for their information and appropriate action.

This is a petition for the reconstitution of Original Certificate of Title No. 6133 filed by petitioner, through counsel. Petitioner alleged, among others; that she is of legal age, Filipino citizen, married with residence at Brgy. Palhi, Baybay City, Leyte; that petitioner is one of the owners of Lot No. 4357 of the Baybay Cadastre, covered by Original Certificate of Title (OCT) No. 6133 of the Leyte Registry of Deeds (Annex "B”), having inherited the same from Emeterio Bandalan and Gorgonia Lara, evidenced by an Extrajudicial Settlement of the Estate (Annex "A"); that the original copy of said title supposedly with the Office of the Register of Deeds of Leyte was lost as certified thereto by said office (Annex "D"); that an additional proof that a title has been issued on Lot No. 4357 of the Baybay Cadastre is a Court Decree under Decree No. 468093 (Annex "C"); that no co-owner's or other duplicates copies of said title had been issued except the owner's copy thereof; that petitioner is in actual possession of Lot No. 4357 of the Baybay Cadastre; that Lot No. 4357 is still declared for taxation purposes in the name of Emerterio Bandalan bearing Tax Declaration No. 2005-07046-00035 R-12 (Annex “E”); that a certified true copy of the Technical Description of Lot No. 4357 as well as the Lot Data computation are made an integral part thereof (Annexes "F" and "G"); that all co-owners of the subject property were notified and furnished of the present petition, namely: Ricardo, Eufronia, Evangeline, Jose Edgar, Elvira and Emma, all surnamed Bandalan, likewise all the adjoining lot owners were furnished of the petition, namely: Fulgencio Vitualla, Fulgencio Pasayloon, Cornelio Placido, Pedro Peza, Mamerto Pancito and Sps. Agapito Berlas and Macaria Pasayloon., all from Baybay City, Leyte. Petitioner most respectfully prayed before this Honorable Court that after due notice, posting and hearing, an order be issued declaring the original copy of Original Certificate of Title No. 6133 which is supposedly in the position of the Register of Deeds for the Province of Leyte as missing, lost and destroyed, therefore NULL and VOID, ordering the judicial reconstitution in like faith and credit as exactly the same terms and conditions on the basis of the owner's copy of OCT No.

6133, and granting such other reliefs as may be just and equitable under the premises.

The petition being sufficient in form and substance, notice is hereby given that this petition is set for initial hearing on March 11, 2014 at 8:30 o'clock in the morning at the session hall of this court. Any person who may have an interest in this petition may file an opposition and show cause why this petition should not be granted.

Let a copy of this order be published in the Official Gazette once a week for two consecutive weeks at the expense of the petitioner and copies of this order be posted in the bulletin boards of the City Hall, at the Post Office and at this Court, all in Baybay City, Leyte, and at the Provincial Capitol, Tacloban City.

Furnish copy of this order to the Solicitor General, the Land Registration Authority, the DENR, the Registry of Deeds of Leyte, the Assistant Provincial Prosecutor, Baybay City, Leyte, all the adjoining lot owners, the petitioner's co-owners, the petitioner herself and her counsel.

ORDER

A verified petition was filed for the reconstitution of Transfer Certificate of Title No. 53780 of the Register of Deeds for Quezon City, alleging among others, that the subject property is owned by the defunct sole corporation, L.R. Pascual & Sons, Inc. wherein petitioner was an incorporator and was an elected director of the board until the dissolution of the said corporation; that during the corporation's existence, it acquired certain properties including a 32,581 square meter lot located at Lot 703B PSD-24021, District of Tandang Sora, Quezon City described in Transfer Certificate of Title No. 53780 with Tax Declaration No. 20992; that sometime in 1972, L.R. Pascual & Sons Inc., caused the subdivision of the said property into four (4) blocks which were issued corresponding titles except the 620 square meter lot located at Lot 1, Block 1 of the Survey No. (LRC) PSD 84261; that the history of tax declarations pertaining to the said lot shows that no title was ever issued since the time it was initially assessed up to the present; that when inquired with the Quezon City Assessor's Office how the tax declarations were issued without the corresponding title, it explained that mere approved subdivision plan sufficed for the issuance of the same absent the submission of a copy of the title at the time it was initially assessed in 1973; that petitioner attempted to procure a certification from the Quezon City Register of Deeds as to whether or not a title was issued on the basis of the tax declaration but the said Office refused to issue the same on the ground that a photocopy of the said title must be first submitted; that considering that there is no proof that a title was issued with respect to Lot 1 Block 1 of Survey No. (LRC) PSD 84261 it is plausible to conclude that the mother title (TCT No. 53780) was merely partially cancelled; that in order to administer the titling of the subject lot, the mother title together with the approved subdivision plan has to be submitted to the Register of Deeds for total cancellation, and in lieu thereof a new title be issued under the same name L.R. Pascual & Sons, Inc. pertaining only to Lot 1 Block 1 considering that all other lots have their respective titles issued; that the titling of the said subdivided

lot cannot be effected on the ground that the original copy of the TCT No. 53780 kept in the records of Register of Deeds of Quezon City was among those records burned, hence there is a need for the judicial reconstitution of the same; that petitioner's efforts to find a copy of the certificate of title were futile, hence he instead attached the (1) technical description of Lot 703-B, PSD-24021 described in TCT NO. 532780, (2) its Tax Declaration (3) its approved Subdivision Plan and (4) its Lot Description in compliance with Sec. 3 of RA 26; that petitioner also attached the lot plan, technical description, tax declaration and receipts of payment of real property tax of the subdivided lot; that while tax declarations and payment of taxes are not conclusive proof of ownership, they have probative value when accompanied by proof of possession or supported by other effective proof; that the tax declaration could stand as evidence of ownership because the certificate of title was never issued as regards Lot 1, Block 1 of the Survey No. (LRC) PSD 84261; and that to prove possession, L.R. Pascual & Sons, Inc. has been religiously paying the realty taxes on the subject property.

Wherefore, notice is hereby given that the petition is set for hearing on December 10, 2013 at 8:30 a.m. before this Court sitting at Rm. 221, Hall of Justice Building, Diliman, Quezon City. All persons having interest in the property are hereby directed to appear at the hearing and file such claim as they may have or show cause why the petition should not be granted.
