OVERTOUR and LETTER of King JAMES VI. anent the Provisioun of the Kirkis of ORKNAY.

November 22, 1615.

AT EDINBURGH the 22 day of November, the yeir of God, Im vi fyftein yeiris, Whairas the particular overtouris underwrittin, concerning the help and supplie of the provisioun of the kirkis of Orknay, being at lenth consultit upoun by the commissioneris of his Majesties rentis, and by thame thought fitting to be proponed to his Majestie, that so his hienes good pleasur and approbatioun might be knowne and understand thairof. The samin thairfoir wes carryed to court by his Majesties thesaurar-depute, and his Majestie maid thair with acquainted. Off the quhilk overtour the tennor followis: WHAIRAS, in the contract past betuix James, now Archbischope of Glasgow, and than Bischope of Orkray, on the ane pairt, and the lait forfaulted Earle of Orkney, thair being appoynted to the said Bischope, ffor mentenance of his estate, the sowme of aught thowsand merkis be yeir, over and besydis the thrids of the said Bischoprick in speciebus as they are sett doun in the book of assumptioun, the haill estait, rentis, and revenewis of the said Earledome being now haillilie appropriat to his Majestie, and annexit to the Crown. Both in regaird of the acquisitioun of all sick right as wes in the persone of Sr John Arnot, quhairupoun appryseing and infeftment had proceidit; and also be reasone of the conviction and dome of forfalture against the said late Earle, the said Earledome of Orknay and lordshipe of Zetland ar thairupon set be his Majestie in tack for certaine yeiris to James, now Lord Uchiltrie, thair being alwayis reservit furth thairof that proportion quhilk locallie for evir is appropriat to the Bischoprick of Orknay, to remaine thair with as patrimonie of the

same, togidder with ane particular assignation of the landis and teyndis equivalent in value to the thrid assumed; and becaus the boundis quhilk ar appoyntit to remayne with the said Bishoprick all tyme heireftir for the causis foirsaid. Thair ar at the present the number of ministeris serveing the cure, whose provisiouns and yeirlie assignatiouns will very neir exhaust the haill quantitie of the thrids assumed, aloteing to the saids kirkis onlie the particular kirks after specifiet. They are to say, Hoy, Wallis and Flottay hes assigned to thame fyve last malt and sex barrell butter. Stromnes and Sandwick hes assigned thrie last half last malt, and sex barrells butter. Orphare hes thrie last half last malt, and sex barrells butter. Holme thrie last fourteine meills malt, and six barrels butter. Schapinscha thrie last malt, six barrell butter. To the reidar at Kirkwall twelff meills malt and six barrellis butter; and to the moderatour of the see, of ane hundreth poundis; so as thair will not remaine of the haill thrids exhaustit meikill more than twa hundreth pundis, and than the haill remanent kirkis of Orknay being of his Majestie's annexed propertie, are for the most pairt altogidder unprovydit; and these who have any thing at all, hes yit so small means of mentenance as no honest man will undertake to serve thame; and thairupoun considderatioun being had vpone the ane pairt, what great greiff our soverane Lord the Kingis most gracious Majestie no doubt wold conceive of sick ane multitude of poor ignorant soulls sould perisch for want of instruction, being at the least to the number of parosches, His Hienes being evir in all his lyffe a rare paragon of pietie, and so bountifull and beneficiall to the kirk, as not spairing his own cofferis to redeem and restore thair ruinat estatis; respect upoun the uther pairt being had with quhat great and hudge sowms of money his Majes tie hes maid purches of the said Sir John Arnots rightis to the landis of the said earldome and yeirlie dewtie to the tak thairoff, sould be abaitted and defaulcat be the provisioun and helping of the ministeris stipendis wha are planted at these kirkis, it might then turne ane evident loss and prejudice to his Majestie. Quhairupoun the commissioneris, appoyntit for manageing of his Majesties rentis, haveing heiranent conferred at lenth with the said archbischop of Glasgow, formarlie titular of the said prelacie of Orknay, and they all concurring in one mynd and resolutione, alswell to prevent the incress and lose quhilk his Majestie may susteane be allowing provisioun to everie ane of these unprovydit kirkis, as on the ane part by uniting and incorporating togidder of such parosche kirkis as may be best conjoyned and served togidder, and by reducing the number of the kirkis and ministeris to sick ane few quantitie, and thair stipendis to sick ane moderat proportion as may be with the least diminution possibil of his Hienes rent; and thairupoun the particular course efter specifiet, as weill for the help and supplie of sick kirkis as ar meinlie pro

vydit, as for the provisioun of uthairis quhilk hes no stipend, is thought be the commissioneris of rentis, and als be the said archbischope, if so his Majestie sall be pleased to allow thairof, the best expedient, with the least detriment possibill to his Majesties rentis. In the first, the tuo parosch kirkis in the yle of SouthRonaldsay, and the parosch kirk in the yle of Burray united, the ministeris stipend to be helped tua hundreth merkis money; the tua kirkis of Deirnes and St Androis, in the mainland united, the ministeris stipend four hundreth merkis money, with the gleibs and viccarages of the saidis kirkis; Birsay and Harray, two parosch kirkis in the mainland, united, the minister stipeind four hundreth merkis money, with the gleibs and viccarages of the saidis kirkis; Evie and Rendall, tuo parosch kirkis in the mainland, united, the ministers stipend thrie hundreth merkis, with the manse, gleibs, and viccarage of the saidis kirkis; the yle of Rowsay and Egilscha, tua parosch kirkis united; the minister stipend thrie hundreth merkis, and the gleibs and viccarages thairof; the yles of Westray and Papa Westray, the ministeris stipend to be helped thrie hundreth merkis, with the viccarage, manse, and gleibs; Burnes, in the yle of Sanday and North-Ronaldsay, tua parosch kirkis, the ministers stipend thrie hundreth merkis; with manssis, gleibs, and vicarage of Northronaldsay, Stronsay, Ethay, and Pharay, four parosch kirkis united, the ministeris stipend to be helped with tuo hundreth merkis; Firth and Stanehous, tuo parosch kirkis in the mainland, to be provyded with thrie hundreth merkis of the superplus of the bischops thrid, with the viccarage, manssis, and gleibs of the saids parroch kirkis. It being alwayis heirwith declared, that this gratuitie for the help, supplie, and provisioun of these kirkis, extending in the yeir to the sowme of tuo thousand four hundreth merkis, payabill furth of his Majesties rentis and dewties of the tack, and divided amongst these united kirkis in maner abonespecifiet be the said archbischope, sall remaine as a solide and constant assignatioun indureing the tyme of the continuance of the present tack; and efter the outrunning thereof, the same proportion of money, and than ane locall assignation of ane chalder of bear for everie hundreth merkis, at the optione of his Majestie's officeris of ressait for the tyme, sall be allotted unto the saidis kirkis, with provisioun alwayis that thair sall nevir be maid any farder motion nor sute for greater augmentation, or for disuniting of the kirkis now conjoyned, quhairby they may be inferred upon his Majesties rent ony greater burden or further provisioun of ony of those kirkis of Orkney in ony tyme heirefter; and this present overtour to have no farder force than his Majestie sall be pleased to allow.
