MEMORANDUM FOR THE CHAIRMAN OF THE ADMINISTRATIVE CONFERENCE OF THE
UNITED STATES

SUBJECT:

Report of the Committee on Adjudication of Claims on Debarment
and Suspension of Persons from Government Contracting and
Federally-Assisted Construction Work

On behalf of the Committee on Adjudication of Claims, I am trans-
mitting herewith our report and recommendations on this subject for
consideration by the Conference. The recommendations and a summary of
this report have also been furnished to your staff for incorporation
in. the agenda of recommendations to be distributed to the Conference.
In preparing this report and formulating the recommendations the
Committee has ascertained the detailed views of the government depart-
ments and agencies concerned and of a special subcommittee of the

American Bar Association.

The Committee is persuaded that adoption and implementation of
the recommendations will greatly improve the procedural fairness of
agency debarment and suspension of individuals and firms from govern-
ment contracting and federally assisted construction work without
prejudice to law enforcement, without harmful delay to government con-
tracting or federally assisted construction work and without undue
administrative burden to the Government. In reaching this conclusion,

we are heartened by the substantial acquiescence in the recommendations by important government procurement agencies, by the Department of Justice, and by the Special Subcommittee of the American Bar Assoc
