ftice or juftices before whom fuch conviction was made; and he or they is or are hereby authorized and required to iffue out one or more warrant or warrants, under his or their hand and feal, or hands and feals, to the constable of the town or place, or 'bailiff or bailiffs of the liberties, wapentakes, or limits, where fuch offender or offenders doth or fhall inhabit, thereby commanding him or them to levy the fame by diftrefs and fale of the offender's goods and chattels, returning the overplus (if any be) after paying likewise the charges of fuch diftrefs and fale, to the offender or offenders demanding the fame; and where no fufficient diftrefs can be found, to commit the offender or offenders to the house of correction, for any time not exceeding three months.

XXV. Provided always, and it is hereby further enacted by the authority aforefaid, That if any perfon or perfons shall find him, her, or themselves, aggrieved by any order or warrant made by any juftice or juftices, or upon any conviction before him or them, in purfuance of this act, fuch person or persons may appeal to the next general quarter feffions to be held for the faid weft riding of the faid county of York, which fhall not be held within fourteen days next after the cause of appeal shall arife, giving ten days notice of fuch appeal to the perfon or perfons discovering the offence on which the conviction was made; and if the juftices at the faid quarter feffions either confirm or difannul the orders or proceedings of the faid juftice or juftices, they fhall allow fuch cofts and charges to the party aggrieved thereby, as they fhall think reafonable; to be levied and paid in fuch manner, as is ufual in cafes of appeal from any order of the juftices of the peace to the feffions, whofe order herein fhall be final.

XXVI. And it is hereby enacted and declared, That the feveral juftices of the peace before whom any conviction shall be made by virtue of this act, as alfo the feveral fearchers, meafurers, infpectors, and fupervisors, fo to be appointed, fhall, and they are hereby required at the four general quarter feflions of the peace in and for the faid riding, held quarterly in every year, to return and tranfmit to the juftices of the peace affembled at fuch general quarter feffions, a true and perfect account in writing, of all the convictions to be made pursuant to this act that fhall happen within their knowledge, and of all the penalties and forfeitures inflicted or levied by means or on account thereof, which, by virtue of this act, are made payable to the faid treasurer for the time being; and fhall, at the fame time, pay or cause to be paid to the treasurer for the time being, all and every fum and fums of money by them, or any of them, or for their or any of their ufe, had or received, for, or on account of any fuch conviction or convictions, and which by this act are made payable to the faid treasurer; and every person and perfons neglecting or refufing to return and tranfmit fuch account, or to pay, or caufe to be paid, fuch fums of money fo by them received, or in their hands, or any part thereof, for the

fpace of twenty days next after any of the faid feffions, and being thereof convicted upon the oath of one or more credible witness or witnesses, before any two juftices of the peace of and for the faid riding (not being dealers in cloth, or occupiers of any fulling mill) thall forfeit and pay the fum of ten pounds, over and above the feveral fums by him or them received, or being in his hands as aforefaid, to be recovered, paid, and applied, in fuch manner as the other penalties inflicted by this act are directed to be recovered, paid, and applied.

XXVII. XXVIII. XXIX. XXX. And be it further enacted by the authority aforefaid,

ted, and not afterwards; and fhall be laid, brought, and tried, in the county of York, and not elsewhere; and the defendant or defendants in fuch fuits or actions fhall and may plead the general iffue, and give this act, and the fpecial matter, in evidence, at any trial to be had thereupon; and that the fame was done in pursuance of, and by the authority of, this act; and if it shall General iffue. appear to be fo done, or if any fuch fuit or action fhall be brought after the time before limited for bringing the same, or fhall be brought in any other county or place; that then the jury fhall find for the defendant or defendants: and upon fuch verdict, or if the plaintiff or plaintiffs shall become nonfuit, of discontinue his, her, or their action, after the defendant or defendants shall have appeared; or if, upon demurrer judgement shall be given against the plaintiff or plaintiffs; the deTreble cofts. fendant or defendants fhall and may recover treble costs, and have the like remedy for the fame as any defendant or defendants hath or have for cofts in other cafes by law.

XXXI. And it is hereby further enacted and declared, That Publick act, this act shall be deemed, and taken to be, a publick act; and all judges, juftices, and other persons, are to take notice thereof as fuch, in all courts and places whatsoever, without specially pleading the fame.

CAP. LII.

An alt for repairing and widening the road leading from the town of Wadhurst in the county of Suffex, to the turnpike road at Lamberhurst Pound and Pullen's Hill, in in the county of Kent; and from the top of Pullen's Hill, through the parishes of Horfmonden, Marden, Yalden, and Weft Farley, to Weft Farley Street, in the faid county of Kent.

CAP. LIII.

An alt for continuing the terms of feveral als, and for giving further powers for repairing the road from Chatteris Ferry, to Hammond's Eau and Somerfham Bridge, and for amending and widening the road from Somersham Bridge to the Sheep Market in Saint Ives; and also the road branching out of the faid road near Stocks Bridge through Needingworth, to Earith in the county of Huntingdon.

CAP. LIV.

An alt for repairing and widening the road from Dunham Ferry, to the fouth end of Great Markham Common, in the county of Nottingham.

CAP. LV.

An all to continue the term, and to vary and enlarge the

powers,

powers, of an act passed in the twenty fifth year of his late Majefty, for repairing the road from Wallingford in the county of Berks, to Wantage, and from thence to Faringdon, and alfo from Wantage to Idfon, in the faid county, fo far as the fame relate to the road leading from Wallingford to Wantage, and from thence to Faringdon; and for difcontinuing the faid term and powers, fo far as the Jame relate to the road leading from Wantage to Idfon, and for repairing the road leading from the north east corner of Nuffield Common, by the parish church of Nuffield, otherwife Tuffield, in the county of Oxford, to the commencement of the faid turnpike road leading from Wallingford to Wantage.

CAP. LVI.

An act for repairing and widening the road leading from Porthaethwy Ferry, to Holyhead in the county of Anglesey.

CAP. LVII.

An act for continuing the term, and altering and enlarging the powers of an act paffed in the thirtieth year of the reign of his late Majesty, for amending, widening, and keeping in repair, the roads leading from the village of Milford in the county of Surrey, through Petworth, to the top of Dunckton Hill, and from Petworth to Stopham Bridge, in the county of Suffex.

CAP, LVIII.

An alt for repairing, widening, and keeping in repair, feveral roads in and near Great Torrington, in the county of Devon.

CAP. LIX.

An act for repairing and widening feveral roads leading from the quay at Limington, in the county of Southampton.

CAP. LX.

An act for continuing and rendering more effectual, two acts, paffed in the twelfth year of King George the First, and the twentieth of his late Majefty, for repairing the feveral roads therein mentioned, in the counties of Effex and Suffolk; and for repairing and widening several other roads in the counties of Effex and Hertford.

An act for repairing, widening, and keeping in repair, feve

CAP. LXII.

An att for enlarging the term and powers of two acts of the thirteenth of George the First, and of the fixteenth of bis late Majefty, for repairing feveral roads leading from the town of Warminster, in the county of Wilts; and for amending feveral other roads near the faid town; and for repealing fo much of an act made in the first year of the reign of his prefent Majefty, for repairing feveral roads therein mentioned, in the faid county, as relates to the road within the town of Heytesbury; and for other purposes therein mentioned.

CAP. LXIII.

An act for repairing and widening the roads leading from the turnpike road at Kipping's Crofs in the parish of Brenchley, in the county of Kent, through the parishes of Brenchley, Horfmoniden, and Goudhurst, by the left band fide of Iden Green, to the turnpike road on Wilfley Green, in the parish of Cranbrooke; and from a place near Goudhurft Gore, through the parish of Marden, to Stile Bridge, in the faid parish, and from Underden Green, in Marden aforefaid, to Wanfhutt's Green, in the county of

An act for repairing, widening, and keeping in repair, the road leading from the turnpike road on Hurst Green, in the county of Suffex, through Etchingham and Burwash, to the extent of the faid parish of Burwash, in the faid county.

CAP. LXV.

An act for rebuilding the parish church of Alhallows on the Wall, in the city of London; and for rebuilding the house belonging to the rector of the faid parish; and for purchafing feveral pieces of ground and tenements thereon, to render the paffages to and from the said church and house more commodious.

CAP. LXVI.

An act to continue the term, and enlarge the powers, of an act paffed in the Second year of the reign of bis prefent Majefty, for repairing and widening the road from Mullen's
