AUTHORITY: §§ 12.1 to 12.12, inclusive, issued under R.S. 161; 5 U.S.C. 22.

§ 12.1 Appointing authority. (a) The Director of Personnel of the Department of Commerce is delegated, in accordance with section 12, 60 Stat. 806, the authority vested by law in the Secretary of Commerce to take final action on matters pretaining to the employment, direction, and general administration of personnel of the Department. In case of the absence of the Director of Personnel, the Acting Director may exercise this authority.

(b) Pursuant to R.S. 161; 5 U.S.C. 22, and the act of June 26, 1930 (46 Stat. 817; 5 U.S.C. 43) (1) Regional Supervisors of the Coast and Geodetic Survey are authorized, subject to such limitations as the Director of the Coast and Geodetic Survey may prescribe, to make appointments of personnel in the field service up to, but not including, Grade CAF-12 or P-5;

(2) The Director and the Executive Officer of the National Bureau of Standards are authorized to make appointments of personnel in the field service up to, but not including, Grade CAF-12 or P-5; and

(3) Regional Directors of the Weather Bureau are authorized, subject to such limitations as the Director of the Weather Bureau may prescribe, to make appointments of personnel in the field service up to, but not including, Grade CAF-12 or P-5.

(c) Pursuant to R.S. 161; 5 U.S.C. 22, the European Director and the Chief of Operations of the Technical Industrial Intelligence Branch are authorized to make appointments of alien and native personnel employed locally and to establish rates of compensation for such employees according to prevailing local practice but not in excess of rates prescribed for similar positions under the salary schedule established by the Classification Act of 1923, as amended (42 Stat. 1488, as amended; 5 U.S.C., and Sup., 661-674).

(d) Pursuant to the act of June 26, 1930 (46 Stat. 817; 5 U.S.C. 43) and section 404 of Reorganization Plan No. 2 3 CFR, Cum. Supp., Chapter IV (1) The Administrator and the Executive Officer of the Civil Aeronautics Administration are authorized to make appointments of personnel in the field service of the Civil Aeronautics Administration up to, but not including, CAF-14 or P-7;

(2) Regional Managers and Regional Executive Officers of the Civil Aeronautics Administration, the Chief of the Standardization Center, the Manager of the Washington National Airport, and the Superintendent, Central Depot of the Civil Aeronautics Administration, are authorized to make appointments of personnel in the field service up to, but not including, Grade CAF-12 or its equivalent;

CODIFICATION: In § 12.1 (d) (2) the words "and Regional Executive Officers" were added after the words "Regional Managers," by Regulation, Acting Secretary of Commerce, Sept. 24, 1946, 11 F.R. 11270.

(3) The Director of the Census is authorized to make appointments of personnel in the field service of the Bureau of the Census up to, but not including, Grade CAF-14 or P-7. (This authorization does not limit the authority of the Director of the Census to employ personnel in accordance with the act of June 18, 1929 (46 Stat. 21; 13 U. S. C. 203) or other statutory authorization to employ personnel without regard to the Civil Service Act or rules or without regard to the Classification Act, as amended, or Schedule A of the Civil Service rules (5 CFR and Supps., Part 50)).

(e) Pursuant to § 1.16 (d) of this Subtitle, the Director of the Coast and

Geodetic Survey and officers and employees serving as chiefs of party, are authorized to employ contract employees on ships, tide observers, seismograph tenders and temporary employees required in connection with surveying operations of the field service.

§ 12.2 Contracting authority. (a) Pursuant to section 161 R.S.; 5 U.S.C. 22, authority is delegated to the head of each primary organization unit (except the Civil Aeronautics Administration and the Inland Waterways Corporation), with authority to redelegate, to approve or execute all contracts (except research contracts of the Office of Technical Services and except supplemental contracts in the amount of $500 or more), accompanying bonds, leases or renewals thereof when the amount in any instance is less than $10,000 and is payable from funds available to such primary organization unit for this purpose.

(b) Authority is delegated, with power to redelegate, to the Administrator of Civil Aeronautics to approve and execute contracts, accompanying bonds, leases or renewals thereof, and contracts supplemental thereto or changes in contracts without regard to limitations established for other primary organization units.

(c) Authority is delegated to the Chief of the Division of Accounting Control, Office of the Secretary, to execute contracts and accompanying bonds for research to be conducted for the Office of Technical Services.

§ 12.3 ́ Inland Waterways Corporation. Pursuant to the act of June 3, 1924 (43 Stat. 360; 49 U.S.C. 151) and section 6 of Reorganization Plan No. 2 of 1939, 3 CFR Cum. Supp., Chapter IV, the President and the Secretary-Treasurer, or those designated by the President of the Inland Waterways Corporation are authorized to sign leases or contracts for the Corporation. The President of the Inland Waterways Corporation is also authorized to formulate rules and regulations for the conduct of the business of the Corporation and to incur obligations and disburse money within the limits of the budget of the Corporation as approved by the Secretary of Commerce.

istrator of the Civil Aeronautics Administration, or such officer or officers as he may designate, is authorized to approve on behalf of the Department of Commerce the location and specifications of any municipal airport located in the State of Nebraska when such approval is required by section 19-803, Compiled Statutes of Nebraska, 1929.

§ 12.5 Authority to act as Secretary. Under Executive Order No. 8541, Sept. 17, 1940 (3 CFR Cum. Supp.), the Assistant Secretary of Commerce is authorized to perform the duties of the Secretary of Commerce in case of the absence, sickness, resignation, or death of the Secretary of Commerce and of the Under Secretary of Commerce, and the Solicitor of Commerce is authorized to perform the duties of the Secretary of Commerce in case of the absence, sickness, resignation, or death of the Secretary of Commerce, the Under Secretary of Commerce, and the Assistant Secretary of Com

merce.

§ 12.6 Executive Order 9630. (a) Those functions of the Foreign Economic Administration transfered to the Department of Commerce by Executive Order 9630 (3 CFR, 1945 Supp.), except the functions of the Technical Industrial Intelligence Committee and the functions of the Clearing Office of Foreign Transactions and Reports, are assigned to the Office of International Trade.

(b) Pursuant to that order authority is delegated to the Director of the Office of International Trade, the Director of the Commodities Branch of said Office, and the Deputy Director for Export Control of said Branch, severally: (1) To exercise and perform all powers and functions contained in section 6 of the act of July 2, 1940, as amended and extended (54 Stat. 714; 50 U.S.C., App. and Sup., 701) and to issue such rules and regulations as may be necessary or proper to carry out the provisions of said Act; and

(2) To exercise and perform such powers and functions as are contained in the Act of October 10, 1940 (54 Stat. 1090, as amended; 50 U.S.C., App., and Sup., 711), and the Act of October 16, 1941 (55 Stat. 742, as amended; 50 U.S.C., App., Sup., 721-724) heretofore conferred upon the Administrator of the Foreign Economic Administration

by Executive Order No. 8942, November 19, 1941, as amended (3 CFR, Cum. Supp.), and thereafter conferred upon the Secretary of Commerce by Executive Order No. 9630, September 27, 1945 (3 CFR, 1945 Supp.), except the power to sign and issue subpoenas.

(c) The functions of the Technical Industrial Intelligence Committee transferred to the Department of Commerce by Executive Order 9630 (3 CFR, 1945 Supp.), are assigned to the Office of Technical Services.

(d) The functions of the Clearing Office of Foreign Transactions and Reports are assigned to the Office of Business Economics. [Regs., effective Sept. 11, 1946, 11 F.R. 177A-302, as amended Sept. 10, 1946, 11 F.R. 10389]

CODIFICATION: In § 12.6 (b) the words "Director of the Requirements and Supply Branch" were amended to read "Director of the Office of International Trade, the Director of the Commodities Branch of said Office, and the Deputy Director for Export Control of said Branch, severally", by Regulation, Secretary of Commerce, Sept. 10, 1946, 11 F.R. 10389.

§ 12.7 Executive Orders 9568 and 9604. The Office of Technical Services is assigned responsibility for performing those operating functions contained in Executive Orders 9568, June 8, 1945, and 9604, Aug. 25, 1945 (3 CFR, 1945 Supp.), responsibility for which is delegated to the Secretary of Commerce by letters from the Director of War Mobilization and Reconversion.

§ 12.8 Executive Order 9665. Those functions of the Smaller War Plants Corporation transferred to the Department of Commerce by Executive Order 9665 (3 CFR, 1945 Supp.) are assigned as follows: (a) The functions of the Office of Reports in the Smaller War Plants Corporation dealing with economic and statistical analysis of business conditions and prospects to the Office of Business Economics;

(b) The field functions of the Smaller War Plants Corporation together with the functions performed in Washington relating to the supervision of such field activities transferred to the Department of Commerce Field Service; and

(c) All other functions to the Office of Small Business. The Director of the

Office of Small Business shall act as Accountability and Liquidation Officer for the Smaller War Plants Corporation and as such may execute necessary instruments in the name of said Corporation. The Director shall also be responsible for preparation of those reports required by section 5, 56 Stat. 355; 50 U.S.C., App., Sup., 1105, which the Secretary of Commerce is required to submit by paragraph 5 of Executive Order 9665 (3 CFR, 1945 Supp.).

§ 12.9 Executive Order 9673. Those functions of the Office of Production Research and Development of the Civilian Production Administration transferred to the Department of Commerce by Executive Order 9673 (Title 3, supra) are assigned to the Office of Technical Services.

§ 12.10 Executive Order 9709. The Weather Bureau is designated as the agency of the Department of Commerce through which the functions relating to meteorological facilities transferred to the Department of Commerce by Executive Order 9709 (Title 3, supra). Civil Aeronautics Administration is designated as the agency of the Department through which all other functions transferred to the Department by that order are performed. The authority vested in the Department of Commerce by Executive Order 9709 (Title 3, supra), including the authority set forth in paragraph 2 to arrange for the interim custody, operation, and maintenance of facilities transferred to the Department under the provisions of the order, is delegated to the Chief of the Weather Bureau and the Administrator of Civil Aeronautics with respect to the functions assigned to their respective organization units.

The authority hereby delegated may be redelegated by the Director of the Office of Technical Services to and exercised by such officer or officers of the Office of Technical Services as he may designate. [Reg., Aug. 28, 1946, 11 F.R. 9733] § 12.12 Delegation of authority to the Administrator of Civil Aeronautics to collect fees. Pursuant to 56 Stat. 1067; 5 U.S.C., Sup., 606, the Administrator of Civil Aeronautics and his duly authorized agents are hereby desig

nated as representatives of the Secretary of Commerce for the purpose of collecting all fees or charges assessed by this Department for services performed or publications furnished by the Civil Aeronautics Administration, pursuant to such approved schedules as the Secretary shall authorize. The proceeds of such collection shall be covered into the Treasury of the United States as miscellaneous receipts as provided in the act. [Reg., Sept. 13, 1946, 11 F.R. 10651]

§ 20.1 Creation. The Census Office was established by the act of March 6, 1902 (32 Stat. 51, as amended; 13 U.S.C. 1 et seq.) to take the decennial census required by Article 1, section 2, of the Constitution and to perform related functions.

§ 20.2 General statement of the purpose and functions. The Bureau of the Census collects, collates, tabulates, and publishes data on the characteristics and activities of the people of the United States in the fields of population, housing, agriculture, manufactures, business, mineral industries, State and local government, cotton and oils, foreign trade, and other subjects. The Bureau also renders statistical services to other Government agencies, as well as to private business and research agencies, individuals, and State and local governments, as requested, and as the regular work of the
