An Act to amend the fixth fection of the act for reducing into one the feveral acts concerning the Land-Office; afcertaining the terms and manner of granting waste and unappropriated land; for fettling the titles and bounds of lands, directing the mode of proceffioning, and preferibing the duty of Surveyors.

THEREAS it hath been reprefented to this prefent General Affembly, that many perfons have located, and lay claim in confequence of fuch location, to the banks, fhores, and beds of the rivers and creeks in the western parts of this commonwealth, which were intended and ought to remain as a common, to all the good people thereof:

Preamble.

II. BE it therefore enacted, That no grant iffued by the register of the land- Grants for beds of tis office for the fame, either in confequence of any furvey already made, or which vers, &c, not valid. may hereafter be made, fhall be valid or effectual in law to pafs any estate or

intereft therein.

III. THIS act shall commence and be in force, from and after the paffing Commencement of this thereof.

CHAP. CCXCI.

II. BE it therefore enacted, That the different county courts fhall have pow- County courts may difer to discontinue any public road, whenever the fame fhall ceafe to be a public convenience. Any perfon intending to apply for the difcontinuance of a road, fhall give one month's notice in fome public paper, and advertise the fame at the door of the courthouse of that county through which the road paffes. On application to any county court for difcontinuing a road, the faid court shall direct their sheriff to impannel a jury of twelve difinterested freeholders, who shall view the fame, being first fworn, and on their oaths fay, whether in their opinion public inconvenience would refult from difcontinuing the fame. The jury fhall certify their opinion under their hands, and deliver it fealed to the sheriff, who fhall return it to the court, who thereupon, as well as upon other evidence, fhall have full power to keep open or discontinue the faid road. Nothing in this act shall be conftrued to authorife any county court to discontinue any public poft road, nor to abridge or alter the power they now poffefs of difcontinuing roads, by fubftituting others in lieu thereof.

III. AND whereas it appears reasonable that the owners of coal mines, Owners of coal mines fhould be placed on the fame footing with the owners of mills, warehoufes, placed on footing with ferries and iron works, and be equally entitled to the benefit of convenient owners of mills, &c. roads. Be it further enacted, that the owners of coal mines fhall be entitled to obtain roads for the carriage of their coal, in the mode prescribed by law to

the owners of mills, ferries, warehouses and iron works.

IV. THIS act shall commence and be in force, from and after the paffing Commencement of this thereof.

CHAP. CCXCII.

An Act to prevent the Burning of the Woods.

[Paffed the 16th of January, 18c2 ]

HEREAS it has been reprefented to this General Affembly, that Pream! e

great injuries have been fuftained by individuals, from the prac

tice of fetting the woods on fire within this commonwealth:

II. FOR remedy whereof, Be it enacted, That if any perfon or perfons Punifhment of perfons fhall fet the woods on fire, unless by accident, or in any manner be concerned for fecting the woods

therein, every fuch perfon fhall pay a fine of thirty dollars for every fuch of- on fire.

and the other to the use of the county wherein the offence was committed; to
be applied towards leffening the levy; And if any fuch person be an infant un-
der the years of eighteen, the faid fine may be recovered in like manner of his
parent, guardian, or mafter; and if any fuch perfon be a free negro or mulatto,
and unable to pay the faid fine, he fhall receive thirty lashes by order of any juf-
tice of the peace.
This act fhall not extend to the counties of Nansemond,
Southampton and Ifle of Wight.

III. THIS act shall commence and be in force, from and after the first day of March next.

E it enacted by the General Assembly, That it fhall and may be lawful for any perfon or perfons to fend or carry by land or upon the waters of the Potowmac, to the District of Columbia, without being inspected, any flour made or manufactured within this commonwealth. Any law to the contrary notwithstanding.

II. THIS act shall be in force, from the paffing thereof.

CHAP. CCXCIV.

An Act to amend an act intituled, an act, reducing into one the feveral acts making provifion for the restraint, fupport and maintenance of Ideots and Lunatics, and the prefervation and management of their eftates.

E it enacted by the General Affembly, That the committee of the eftate of an ideot or lunatic removed to the hospital in the city of Williamfburg, fhall account with the Auditor of Public Accounts and pay into the Treafury, as well what he may be liable to pay for the expenfes attending the removal of fuch ideot or lunatic, as for his or her annual fupport while in the hofpital; and the bond of fuch committee fhall in all future cafes be fo changed as to make him account and pay as aforefaid, and the faid committee shall account for and pay the faid expenfes of removal and the first year's fupport of fuch ideot or lunatic, within twelve months after the date of his bond, and the allowance for his or her annual fupport on or before the fame day in each year thereafter, fo long as the faid ideot or lunatic fhall remain in the hospital.

II. BE it further enacted, That the clerk of the court by whom the comauditor copies of bonds mittee fhall be appointed to an ideot or lunatic fo removed as aforefaid, within fix months thereafter, fhall tranfmit to the Auditor, a certified copy of the bond of fuch committee, and alfo of the order of fuch court relative to faid ideot or lunatic, and his eftate; and the court of directors fhall, whenever an ideot or lunatic fhall be received into fuch hofpital, certify to the Auditor an account of the expenfes attending his or her removal, and alfo the fum allowed for his or her annual fupport, and when any fuch ideot or lunatic shall be difcharged, the court of directors, fhall certify the fame to the Auditor of public accounts, which copy of the bond of a committee with the order of the court aforefaid, and the certificate of the court of directors may be given, and fhall be received, as evidence againit any fuch committee on a motion made against him under this act; and if any fuch committee fhall fail to account and pay into the Treafury as aforefaid, the expenfes attending fuch removal and the allowance for the annual fupport of fuch ideot or lunatic fo long as he or he shall remain in the faid hofpital, then and in that cafe the Auditor shall be, and he is hereby authorifed and required, forthwith to recover of fuch committee by motion in the General court, the fum due on account of fuch ideot or lunatic: Previded always, that twenty days previous notice be given to fuch committee of the faid motion.

III. ALL acts and parts of acts, coming within the purview of this act, are hereby repealed.
